Welcome! We are thrilled that you have chosen our condo to rent for your vacation.

The most important rule to know is that this is a completely smoke-free property, inside and outside. To book this property you must certify that everyone in your group is a non-smoker and that the responsible party is over age 25.

We take pride in ensuring that your vacation home is ready for your arrival to give you the most pleasant and relaxing visit. If there is anything we can do to ensure your vacation is even more spectacular than you hoped, please let us know. We want to ensure your vacation is everything you envisioned and more so you will come back year after year and become part of our growing family.

By agreeing to this transaction, you (the primary Guest) are agreeing to abide by all of the terms of the below short-term rental contract (hereinafter “Contract”), and by the Official Rules of Oceanway Condominium (hereinafter “Rules”). You are agreeing to the Contract and Rules on behalf of yourself and all other Guests (your family members and anyone else staying with you during your stay, and any visitors you may have to the property during your stay), and you hereby certify that you have provided the Contract and Rules to each adult Guest (and explained it to each Guest who is not yet an adult) that each Guest has directed you to agree to this contract on their behalf.

SHORT-TERM RENTAL CONTRACT


1) No more than 6 occupants are allowed.
2) Check in is at 4pm or later / Check out is by 10am.
3) Any damage or loss to building, furniture, fixtures, or appliances will be based on the walk through by our housekeeper after you check out and deducted from you security deposit.
5) Responsible adult over age of 25 years renting property must be present during entire visit.
6) Absolutely no smoking inside or outside the unit, including the balcony and pool area and parking area, as this is a smoke-free building. Second-hand smoke and smoke residue on clothing will contaminate the unit. By signing this contract, you are stating affirmatively that no one in your party smokes and you will not allow any visitor to smoke in the unit or outside of the unit anywhere on the premises of Oceanway Condo. You will forfeit your entire deposit if evidence of smoking, smoke odor, or smoke residue is found once you check out.
7) No boats or trailers are to be parked at our rental property, as they will not fit in our parking structure.
8) All visitors and renters must abide by the rules and regulations of the Condominium Association as are posted on the refrigerator in the unit.
9) Do not move the furniture.
10) Do not mix your laundry with ours; please wash and dry your belongings separately from our towels and linens.
11) Remove all garbage to outside dumpster during your stay and before you checkout. To find the dumpster, please go out the front door, turn left, go down the stairs, and the dumpster is behind the chain link gated enclosure.
12) When you checkout, please keep beds intact that have not been slept in.
13) When you checkout, be sure to return key to the lockbox. If the key is missing, you will be responsible for the cost of a locksmith. There is also a $50 charge for each lost key.
14) When you checkout, close and lock all outside doors and windows and shades.
15) No pets or other animals are allowed.
16) Liability / Damage Responsibility:
Renters will be financially responsible for any damages to any property belonging to the Owner or any other person from fire, water, or casualty caused by the Renter’s negligence.
17) Renter agrees to hold Owner harmless from all claims of loss or damages to the property, and on injury or death to persons caused by the intentional acts or negligence of the Renters, this applies to Renter’s guests or invitees or anyone else on the premises with the Renter’s consent. Payment for repairs will be due within 7 days of the incident.
18) Except as provided by Florida law: Owner shall not be liable for personal injury or damages or loss of Tenants personal property from theft, vandalism, fire, or any other causes whatsoever. Renters expressly absolve Owner from any and all water damage caused by pipes, or storms.
19) In no event will Owner be responsible for any compensation due to annoyance, or inconvenience for loss of use due to a casualty which occurs on the premises. This also applies to any damages or loss to any vehicles or other equipment Renters might have brought with them.
20) The Renter shall notify Owner through the rental App in the event that they become aware that the condition of the Unit requires any repairs, and Owner shall make all reasonable efforts to have such repairs made as quickly as possible, but Owner cannot guarantee how quickly such repairs will be made.
21) The Renter shall notify the property manager if any part of the Property outside of the Unit needs to be repaired. The phone numbers of the property managers are located on a sign on the ground level to the right of the elevator. The Owner shall have no personal liability with respect to the violation of any laws, ordinances, orders. or other requirements affecting the Property. To the full extent permitted by law, the Renter understands that they are renting at their own risk. The Owner will not be held liable for any negligent acts committed by others and will be held harmless from any and all loss, damage or expense, including litigation costs and attorney’s fees arising from any liability or claim. Owner assumes no liability whatsoever for any acts of omission or any liability for any failure of others to perform. Owner assumes no liability for previously unknown violations of environmental or other regulations which may become known during the period this Agreement is in effect.

OCEANWAY CONDOMINIUM OFFICIAL RULES

These rules are for your safety, and to help ensure you enjoy your stay. These rules and regulations will be enforced by the Oceanway Condominium Association (the “Association”) to the fullest extent as provided by the Statutes of the State of Florida, the Condominium Declaration, its Articles and Amendments. Infractions may result in fines placed upon the owners and guests.

  1. No-Smoking – Smoking and vaping is absolutely prohibited at Oceanway, inside all individual units and outside on balconies and in all outdoor common areas, including but not limited to the elevator, the pool area, the parking structure, the stairwells, near the roof, or anywhere else on or within 50 feet of the Oceanway Condominium property. If you are found to be smoking or vaping on the property, you will be required to vacate the premises and relocate to another building at your own expense, and you will forfeit your security deposit and any fees paid for the remainder of your stay.
  2. Number of Guests – Maximum occupancy of each unit is 6 persons, including children and infants.
  3. Parking – Each unit is assigned one reserved parking space. All vehicles must park in your unit’s assigned space or a space marked Guest. If you have a second vehicle, ask for a Guest Parking Pass. You must display the unit parking pass or a Guest Parking Pass on the dashboard of your vehicle. Vehicles without a valid Parking Pass are subject to towing.
    3.1. No backing into any spots. You MUST Park FRONT END IN; this is Florida Law.
    3.2. Height Limit is 7 Feet. Drivers of over-height vehicles are responsible for any damages to sprinkler heads, ceiling fixtures, plumbing pipes, etc. Be sure to measure your vehicle height, including any roof rack and including any storage containers placed on, or to be placed on, your roof rack, BEFORE bringing your vehicle.
    3.3. Oversized Vehicles. If you have a long pickup truck or other oversized vehicle that would stick out into the center right of way under the building, please park in a guest spot out by the road at the front of the building.
    3.4. Drive Carefully. Be very careful to avoid hitting parking columns, plumbing pipes attached to the columns, and the storage units along the wall.
    3.5. Report Unauthorized Vehicles. If you see an unauthorized vehicle, feel free to report it to the property manager of the association or the rental manager or owner of your unit. To keep our condo parking and our pool from being used by unauthorized persons, the Association strictly enforces the rules and calls the local police if there’s a problem.
    3.6. Vehicle Damage or Stolen Property. The Association is not responsible for vehicle damage or broken or stolen property such as bicycles or other personal items.
  4. Pool Rules – The association assumes no liability in case of pool accidents. No lifeguard is ever on duty. All owners, renters, and guests swim and use the hot tub at their own risk. All people using the pool and/or hot tub are required to follow all rules posted on the wall located on the pool deck. If you do not follow the rules and the Association is charged, you will be personally responsible for said charges.
    4.1. Adult Supervision. Adults must accompany and supervise children under 18 at all times.
    4.2. No Smoking. Absolutely no smoking in the pool or pool area or anywhere else on the Oceanway property (see Rule #1).
    4.3. No Sand or Oil in the Pool. Please keep sand and oil out of the pool. Before using the pool or hot tub, be sure to shower to remove sand and oil.
    4.4. No Glass in Pool or Pool Area. Absolutely no glass is permitted in the pool and/or hot tub area, including no beer bottles or glass cups. Any broken glass or bottle will require the pool to be shut down until the City has inspected and allowed the pool to re-open. The Association can also be fined by the city, and these fines will be the responsibility of the person who brought the glass to the pool.
    4.5. Gates Must Stay Locked. Both pool gates must stay closed and locked when not entering or exiting the pool area. Each unit has a gate code. Owners are responsible to ensure the codes are available for renters and guests. Do not let anyone hear you shout out the gate code and do not give the code to anyone unless you are certain they are staying at Oceanway.
    4.6. Children Under 18 Must be Supervised. Children under 18 must be supervised at all times pursuant to Florida Law and the rules of this condominium.
    4.7. Hot Tub Minimum Age. Children under 16 are not allowed in the hot tub pursuant to Florida Law and the rules of this condominium.
    4.8. Infants and Babies. Infants and babies must wear Little Swimmers type diapers designed for pool use. Any feces in the pool results in a shut down of the pool for 12 hours and an inspection from the city. Please remind your child to use the restroom before and often while using the pool. This problem can ruin the holiday for everyone staying at Oceanway.
    4.9. Pool Furniture. Do not remove any pool furniture from the pool deck.
    4.10. Cooperation with Property Management. Property management comes at least once a week to clean the pool and ensure proper chemical balance, and also to ensure that rules are being followed. Please cooperate with our Property managers. We have asked them to immediately call the Association board if our condo rules are not being adhered to.
    4.11. City Inspections. Please note that our condo is often inspected by the city, and fines and pool closures may ruin your great holiday.
  5. Supervision of Children – Children under 18 must be under adult supervision at all times, with no exceptions.
  6. No Running or Loud Playing. For the safety of your children and for the safety and enjoyment of all Oceanway guests, do not allow children to run or play loudly in the garage, in the pool area, in the outside stairwells, or anywhere inside the condominium unit such as the hallways, bedrooms, and living areas. Oceanway is a wood frame building with no sound insulation between floors, which means that the running and playing of children inside your unit is extremely noisy and disturbing to guests staying below you. The beach is the appropriate area for children to run and play. There are also nearby parks designed for children to run and play. The nearest park is Kolb Park and Playground, located on Bay Palm Boulevard between 15th Avenue & 16th Avenue (across from City Hall, IRB Library, and the Beach Art Center).
  7. No Parties – For the safety of your family and for the safety and enjoyment of all Oceanway guests, no parties of any kind are allowed at the Oceanway pool or inside any Oceanway units. This includes pool parties, birthday parties, barbecues, etc. The only exception to this is for an adult poolside party approved in advance by the condominium board.
  8. Garbage – All garbage and trash must be contained, sealed, and placed in the dumpster located on the north side of the building by the street. Do not leave garbage outside your condominium door or on the ground in the dumpster area.
  9. Elevator – Absolutely no smoking in the elevator (see Rule #1). Please do not track sand or water into the elevator. Children are not permitted to use the elevator unless they are accompanied by an adult. You are responsible to ensure that your children do not push the emergency button located in the elevator. This is an extremely important rule, as an emergency procedure is followed when the button is pushed. The Association will also be charged an emergency response fee from Police and Fire Department, which will be the responsibility of the parent or guardian of the child who pushed the button.
  10. Balconies – Absolutely no smoking on the balconies (see Rule #1). Do not drape towels, swimsuits, or other clothing over the balcony rail. Do not throw or drop items from the balcony, and please be extremely careful to prevent glass objects from falling off the balconies, as any glass breakage on the pool deck will cause temporary pool closure.
  11. Noise – Please be aware that our building is a wood frame building with no sound insulation between floors. This means that the family underneath you can hear you walking and moving furniture, and children running up and down the condo hallways sounds like a thunderous stampede in the unit below you and destroys the tranquility of an ocean-front vacation for many of our guests. Accordingly, please remove your shoes inside, walk lightly, and ensure that your children do not run inside the condo. When moving dining chairs or barstools to sit, please try to lift and move them rather than sliding them on the floor.
    11.1. Quiet Hours. In all cases, noise should be kept to a minimum from 9pm to 9am.
    11.2. Music. Please be extremely considerate when listening to music outside at the pool or on balconies, to ensure that others will not be disturbed. If you desire to listen to music at the pool, please be considerate of the type of music and the volume. Ask others at the pool and outside on the balconies if they mind the type of music you are playing, or if it is too loud.
  12. Bird Feeding – Please do not feed the birds or other wildlife on the premises.
  13. Personal Items – Please use the storage lockers to store all beach and pool items. Do not leave personal items such as pool toys, rafts, etc. in the pool area when you are not present. Please do not leave items in the parking garage or in the hallways.
  14. Bicycles – If you rent or bring a bicycle, you can lock it in the bike rack near the elevators, on the grass, or at the public bicycle rack near the beach access ramp. The Association is not responsible for stolen or broken bicycles.
  15. No Pets – Oceanway is a pet free building for renters and their guests.
  16. Grills – If you use a propane grill, please clean it when done, and please turn off the propane on every knob and turn off the propane tank.
  17. COVID-19 – Some renters and guests may still practice social distancing at our building. We do continue to clean and sanitize the elevators and pool area regularly. Your condo should have been thoroughly cleaned and sanitized by the owners’ cleaners prior to your stay. If you or anyone in your group is sick, please see a doctor.
